Emvio AI is an AI-powered conversational companion designed to provide emotional support, facilitate self-reflection, and serve as a private, non-judgmental space for users to express their thoughts and feelings.
The Service uses artificial intelligence and natural language processing to generate contextual, emotionally aware responses. The Service is designed to remember conversation context over time to provide a more personalised experience.
The Service is provided "as is" during the beta phase. Features, capabilities, and availability are subject to change. We make no guarantees regarding the accuracy, completeness, or appropriateness of responses generated by the AI.
Emvio AI is currently in beta. The Service may contain bugs, errors, and incomplete features. By using the beta, you acknowledge and accept these limitations.

We reserve the right to terminate or suspend accounts that violate these Terms, engage in prohibited conduct, or where we have reason to believe the account poses a risk to the Service or other users.

Data retention: We retain your data for as long as your account is active. Upon account deletion, personal data is removed from active systems within 30 days. Anonymised aggregate data may be retained as permitted by law.
Security: We implement industry-standard encryption (TLS in transit, encryption at rest) and access controls. No system is perfectly secure. In the event of a breach, we will notify affected users as required by applicable law.
All content, software, design, branding, and technology comprising the Service โ including but not limited to the Emvio AI name, logo, AI models, code, user interface, and documentation โ is the exclusive property of Emvio AI and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to:
Any feedback, suggestions, or ideas you submit regarding the Service may be used by us without obligation or compensation to you.
You retain ownership of the content you submit to the Service, including your messages and any information you share in conversations ("User Content").
By submitting User Content, you grant Emvio AI a limited, non-exclusive, royalty-free licence to use, store, and process your User Content solely for the purpose of providing and improving the Service. This includes using anonymised, de-identified data to improve AI performance.
You represent and warrant that your User Content does not violate any third-party rights or any applicable laws. You agree not to submit content that is:

Violation of these prohibitions may result in immediate termination of your account and, where warranted, referral to law enforcement authorities.
Emvio AI may integrate with or rely on third-party services (such as cloud infrastructure providers, AI model APIs, or communication services) to deliver the Service. These third parties have their own privacy policies and terms of service.
We are not responsible for the practices, content, or availability of third-party services. Links to third-party websites on our platform are provided for convenience only and do not constitute endorsement.
Where third-party services process your personal data, we ensure appropriate data processing agreements are in place as required by GDPR and DPDPA.
We reserve the right to modify, suspend, or discontinue all or any part of the Service at any time, with or without notice, including during the beta phase. We will make reasonable efforts to notify users of significant changes.
We may terminate or suspend your access to the Service immediately, without prior notice, if you violate these Terms or if we determine that continued access poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination โ including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution โ will survive.
You agree to indemnify, defend, and hold harmless Emvio AI, its founders, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

This limitation reflects the fact that the Service is provided free of charge during the beta phase and is a core component of the consideration for your use of the Service. Nothing in this section limits liability that cannot be excluded by law, including liability for death or personal injury caused by gross negligence, or fraudulent misrepresentation.

Nothing in this section shall prevent us from seeking injunctive or other equitable relief in any competent court where required to protect our intellectual property or prevent irreparable harm.
Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes informally. If you have a dispute with us, please contact us at aaryansharma@emvioai.com with a description of the issue. We will make a good-faith effort to resolve the matter within 30 days.
For Indian users: Disputes that cannot be resolved informally shall be submitted to binding arbitration under the Arbitration and Conciliation Act 1996 (India). The seat of arbitration shall be Chandigarh. The proceedings shall be in English.
For EU users: You may also submit complaints to your national data protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
For US users: Any dispute shall be resolved through binding individual arbitration under the American Arbitration Association rules. You waive any right to participate in class action litigation.
Notwithstanding the above, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
We reserve the right to update these Terms at any time. When we make material changes, we will:

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
These Terms are written in English. In case of any conflict between an English version and any translation, the English version shall prevail.
